Canada Eases Work Permit Requirements for Provincial Nominee Candidates

Immigration, Refugees and Citizenship Canada (IRCC) has introduced a temporary public policy to streamline the process for foreign nationals looking to work in Canada while they’re pursuing permanent residency through the Provincial Nominee Program (PNP). This policy is in effect until December 31, 2024, and offers a new opportunity for those who are currently navigating the PNP process.

Under this policy, foreign nationals who meet certain criteria can apply for an open work permit, allowing them to work for almost any employer in Canada. To qualify, individuals must:

1. Have a job offer in Canada.
2. Hold a valid Canadian work permit or have had one that expired on or before May 7, 2024.
3. Obtain a support letter from the province or territory confirming their participation in an Expression of Interest Pool or a similar permanent residence application process.

Typically, individuals seeking to become permanent residents through the PNP need to first enter an Expression of Interest Pool, submit a provincial application, and receive a provincial nomination before they are eligible to apply for an open work permit. They usually can only get this permit after submitting their permanent residence application, following completion of all these steps.

The new policy accelerates this process, allowing eligible candidates to start working in Canada sooner. This temporary measure aims to provide flexibility and support for those in the midst of their PNP journey, enabling them to contribute to the Canadian workforce while their permanent residency applications are being processed.
